About this office

The President of India is the Head of State and the first citizen of the Republic. The executive power of the Union is formally vested in the President but is exercised on the aid and advice of the Council of Ministers headed by the Prime Minister (Articles 53 and 74). The office is deliberately non-partisan.

Term

5 years; eligible for re-election (Article 56).

How the office is filled

Indirectly elected by an Electoral College of the elected members of both Houses of Parliament and of the Legislative Assemblies of the States and of Delhi and Puducherry, by a single transferable vote (Articles 54-55).

Key powers and functions

  • Appoints the Prime Minister and, on the Prime Minister's advice, the other Union ministers (Article 75).
  • Gives assent to Bills passed by Parliament; a Bill becomes law only on the President's assent (Article 111).
  • Summons and prorogues the Houses of Parliament and can dissolve the Lok Sabha (Article 85).
  • Supreme Commander of the Armed Forces of India (Article 53).
  • Appoints Governors, the Chief Justice and judges of the higher judiciary, the CAG and Election Commissioners, among other constitutional posts.
  • Can grant pardons, reprieves and remissions of punishment (Article 72).
